TERMS AND CONDITIONS                                                                                                            

 

The Crystal Consulting (Bayvets) confirmation email with cash payment option or Pay Pal payment receipt will need to be presented to the technician for verification prior to any services being performed. You will be contacted by our staff to review your service and any additional requirements for service before your appointment.  

Scheduling:
Standard service hours are Monday — Friday 8 A.M. to 6:30 P.M., Saturday-Sunday 9 A.M. to 5 P.M. Additional charges may apply for rapid response, holiday or service outside of standard hours.

Customer Responsibilities:   

An adult (18 years or older) must be present during the entire installation or repair process. If the technician arrives at the scheduled time and no adult is present, or if the adult leaves prior to the service being completed, the technician will leave and you will be subject to the stated service charges. 

You must type in all passwords for security purposes.   

It is your responsibility to back up all software and data on your computer's hard drive(s) and/or any other storage devices before the Crystal Consulting (Bayvets) technician arrives. Crystal Consulting (Bayvets) and/or its third-party service provider shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files.

Customer is responsible for any data migration to a new PC or hard drive. Data transfers are available for an additional fee.   

Customer is responsible for the removal of any packing materials or trash.   

Emergency/Repair Services:

Outlined prices do not cover liquid spillage, impact damage, missing parts or any effects of neglect, misuse or abuse discovered at initial diagnostic check or while work is being performed. Emergency Repair Service requires a $90 nonrefundable diagnostic fee once service is initiated. There are certain proprietary brands that Crystal Consulting (Bayvets) may not be able to repair due to part availability and manufacture warranty. This will be communicated if Crystal Consulting (Bayvets) is unable to repair your machine.

Tasks That Must Be Completed Prior to Install or Repair:

Please back up all vital data files prior to service being performed. Crystal Consulting (Bayvets) is not responsible for lost data. 

Any hardware devices, components, peripherals, software or cabling needed for the install must be purchased and supplied by you. 

If network connectivity is desired for multiple devices, you must supply device (router, hub, modem or switch) with adequate number of ports to support the required number of devices. 

ISP/Internet or home network connection must be activated and working properly prior to any related install. 

All equipment being installed must be located in the general area where the install is taking place. 

The technician must be given immediate access to the equipment so the service call can begin as scheduled. Customer must provide adequate environment (power, space, etc.) for the scheduled service. 

Customer is responsible for providing power cords and surge protectors. 

Customer must have available all legally licensed software, verification keys and media that may be required.

Service Warranty: 

Crystal Consulting (Bayvets) warranties its workmanship (there is no warranty for software repairs) for a period of 30 days from the service date.  This includes issues with the configured installation set up by the technician. Crystal Consulting (Bayvets)  is not responsible for issues due to setting changes, new software upgrades, ISP connection issues, relocation, viruses or Spyware issues, or misuse. A complete terms and conditions document will be supplied to you at the scheduled service call.   Additional trips not covered by the warranty will be subject to charges.

- Tutorial services are not covered under this warranty

- Crystal Consulting (Bayvets)  warranty is only valid on Virus, Spyware and Adware removal service if Crystal Consulting (Bayvets) technician verifies proper protection against such threats  

Service Liability Limitations:

(a) Limitations to Service: 

Under no circumstances shall, Crystal Consulting (Bayvets) and/or its third-party service provider be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by Crystal Consulting (Bayvets) and/or its third-party service provider or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder.

Crystal Consulting (Bayvets)  and/or its third-party service providers shall not be liable for any failure or delay in performance due to any cause beyond its control. If Crystal Consulting (Bayvets) ability to render services is impaired by your failure to cooperate,  minimum system requirements are not met, technical conditions (such as wiring difficulties or physical barriers)  or circumstances beyond the control of Crystal Consulting (Bayvets) , Crystal Consulting (Bayvets) may choose not to provide any or all services and reserves the right at our discretion to refund the customer's payment, wholly or in part. Service can also be denied if dangerous or unhealthy conditions are present including possible code violations. For any un-installation services provided, Crystal Consulting (Bayvets) shall not be responsible for repairing any damage or changes made to your residence.

(b) Limitation of Liability & Release: 

By signing the form on the opposite side of this page, you agree to release and hold harmless , Crystal Consulting (Bayvets) and/or its third-party service provider from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by Crystal Consulting (Bayvets). This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals, any changes or alterations to your residence (for example, changes to walls, baseboards, floors, etc.) as a result of Crystal Consulting (Bayvets) and/or its third-party service provider's agents, partners, and/or third-party service providers, regardless of the warranties, disclaimers, and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you. Some states do not allow limitations or release of certain damages or liability, so the above limitation of liability and release may not apply to you.

(c) The customer hereby confirms that a full back-up of the Customer's hard-drive or other devices has been made prior to Crystal Consulting (Bayvets) commencing the services and that there is no legal restriction or impediment to Crystal Consulting (Bayvets) providing services to or for the Customer.

"No Fix, No Fee Policy:

1. The ‘no fix no fee’ policy applies only to home users. The ‘no fix no fee’ does NOT apply to business users.

2. If the technician can offer a solution but the customer chooses not to proceed then the customer will be charged for the time spent on site to that point.

3. If the technician is only prevented from resolving a problem because the customer does not posses the appropriate software disks, cables, hardware, drivers, etc., or product serial numbers the customer will be charged for the time spent on site to that point.

4. If the technician diagnoses a fault with a customers Internet Service Provider, even when the ISP attempt to deny any fault the customer will be charged our standard rates for the time spent on-site.

5. The 'no fix no fee' policy does not apply to diagnostic fees.

 

Changes, Cancellations, and Refunds Cancellation Policy:

To change your order:  You must contact Crystal Consulting (Bayvets) via our Support services form, email or by phone. 

To cancel your order: You must contact Crystal Consulting (Bayvets) via our Support services form, email or by phone for any cancellation within 24 hours of scheduled on-site service or there will be a $50 fee, if the technician is on-site a $99.00 fee will apply. We reserve the right to invoice any customer where cancellation occurs less than 24 hours prior to any appointment.  Technical Service fees are nonrefundable once the service process has begun (any cancellations must be made prior to actual service to receive any prorated refund).  

If you are not satisfied with your service: contact Crystal Consulting (Bayvets) via our Support services form, email or by phone for resolution. We stand by our In-Home service for 30 days. If there is a problem with the service we provided and you notify us within the allotted time period, we will work to remedy the problem quickly at no additional cost. Minimum System Requirements for Wireless Home Networking Only:

Please check to see that your computer meets these minimum requirements:

• At least 10MB free of hard disk space and 32 MB RAM on each computer

•Operating system and/or ISP passwords must be available

•Microsoft Windows 2000 operating system or later 

•Windows® operating disk or restore disk must be available with key codes at the time of installation  

• A broadband or cable connection, if any, must be installed and operational before service, including modem connections, before the technician arrives.

• All computers and peripherals to be networked must be virus and spyware free and all devices being connected must be in good working condition.

• Internet connection, router and primary PC must be in the same room  

For narrowband (dialup) networking, we will connect only to MSN or EarthLink.

      The technician must have: 1) access to your residence or business and the computer(s) and/or peripheral(s) to be serviced, 2) your consent and cooperation to enter your residence or business, 3) a safe working environment, work space, and 4) electrical power. If the Crystal Consulting (Bayvets) technician determines that these conditions have not been met, services will be denied and a $99.00 cancellation charge assessed.

 

      We reserve the right to modify our Terms and Conditions at anytime and to refuse service to anyone.
